1. Designated DMCA agent
Notices of claimed infringement under 17 U.S.C. § 512(c)(3) should be addressed to our Designated Agent: VIVIROS DMCA Agent, 88 Market Square, London EC2V 8BB, United Kingdom, with email copy to [email protected]. We accept notices in English. For service in the United States, our agent of record is registered with the United States Copyright Office.
2. Required content of a DMCA notice
To be valid, a notice must include:
- A physical or electronic signature of the rights-holder or authorized representative.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with sufficient information to locate it (typically a URL).
- Contact details of the complaining party (full name, postal address, telephone, email).
- A statement that the complaining party has a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law.
- A statement, made under penalty of perjury, that the information is accurate and that the complaining party is authorized to act on behalf of the rights-holder.
3. Counter-notification
If you believe your content has been removed in error, you may submit a counter-notification including:
- Your physical or electronic signature.
- Identification of the removed material and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your full name, address, telephone number and email, plus consent to the jurisdiction of the federal district court in which your address is located.

4. How we process notices
Upon receipt of a complete notice, we acknowledge it within one business day, evaluate the claim, and act accordingly. Where the matter is complex or contested, we engage senior attorneys and may consult external counsel. The customer’s instructions take priority where the notice was filed by VIVIROS on its behalf. We maintain a complete log of every notice and counter-notice, available for audit on request.
5. Repeat infringers and abuse
In accordance with 17 U.S.C. § 512(i), we maintain and enforce a policy of terminating, in appropriate circumstances, the accounts of subscribers and account holders of our customers who are repeat infringers. Submission of false notices is a serious offence and may result in legal action against the complainant.
